Terms & Conditions — AI Skin Analyzer & Skin Care

1. Introduction
These Terms & Conditions apply to the AI Skin Analyzer & Skin Care mobile application (the “Application”), operated by IOBits Technologies (the “Service Provider”).
By downloading, accessing, or using the Application, you agree to these Terms & Conditions. If you do not agree, please discontinue using the Application.
2. Eligibility
You must be legally permitted to use the Application in your jurisdiction. The Application is not intended for children under 16 years of age, or any higher minimum age required by applicable law.
Where parental or guardian consent is legally required, the Application may only be used in accordance with the applicable requirements.
3. License to Use the Application
Subject to these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or create derivative works from the Application, except where expressly permitted by applicable law.
4. Intellectual Property
All intellectual property rights in the Application, including its software, design, branding, logos, and other materials, belong to the Service Provider or its respective licensors.
You may not use or reproduce these materials without authorization, except as permitted by applicable law.
5. AI-Powered Features and Google Gemini API
The Application uses Google's Gemini API to support AI-powered features, including skin analysis, skincare suggestions, and the generation of results based on information submitted by users.
When you choose to use an AI-powered feature, the relevant photos, images, text prompts, or other information you submit may be transmitted to Google's Gemini API for processing and generation of the requested results.
The processing of such information is subject to the Application's Privacy Policy and the applicable terms and privacy policies of Google.
AI-generated results may be inaccurate, incomplete, or unsuitable for your particular circumstances. You are responsible for using your judgment when interpreting and acting on the results.
The Application does not guarantee that AI-generated recommendations will produce particular results.
6. Medical and Skincare Disclaimer
The Application provides general skincare information and AI-generated suggestions for informational and educational purposes only.
The Application is not a medical device and does not provide professional medical diagnosis, treatment, or advice. AI-generated skin analysis should not be relied upon to diagnose skin diseases or other medical conditions.
Results may be affected by image quality, lighting, the information provided, and limitations of artificial intelligence.
Always consult a qualified healthcare professional or dermatologist if you have concerns about your skin, notice unusual changes, or need medical advice. Do not delay seeking professional care based on information provided by the Application.
7. User Responsibilities
You agree to:
Use the Application lawfully and responsibly.
Provide information and images that you are authorized to submit.
Avoid uploading images or personal information belonging to others without appropriate permission.
Avoid using the Application to violate another person's rights or applicable law.
Avoid attempting to interfere with the Application's security, operation, or functionality.
Avoid using the Application for unlawful, fraudulent, or harmful purposes.
You are responsible for maintaining the security of your device and any information you use to access the Application.
8. User-Submitted Information and Images
You retain any rights you already have in the photos, images, and other content you submit through the Application.
You authorize the Service Provider to process such content as reasonably necessary to operate the Application and provide the features you request, including transmitting relevant content to Google Gemini API for AI processing.
This authorization does not transfer ownership of your content to the Service Provider.
The handling, sharing, storage, and deletion of personal information are explained in the Application's Privacy Policy.
You should avoid submitting unnecessary personal information when using AI-powered features.
9. Third-Party Services
The Application may use third-party services to provide AI functionality, analytics, advertising, crash reporting, and other features.
These services may operate under their own terms and privacy policies. The Service Provider does not control every aspect of third-party services and cannot guarantee their uninterrupted availability.

10. Advertising and Payments
The Application may display advertisements or offer paid features, subscriptions, or in-app purchases.
Where charges apply, the applicable price, billing terms, and relevant conditions will be presented before purchase.
Purchases made through Google Play are subject to the applicable Google Play billing and refund policies.
Subscriptions, where offered, may automatically renew unless cancelled according to the applicable subscription terms.
The Service Provider may introduce, modify, or discontinue features or pricing, subject to applicable law and any existing contractual obligations.
11. Internet Connectivity and Device Requirements
Some features require an active internet connection. The Service Provider is not responsible for interruptions caused by network failures, mobile service providers, or circumstances outside its reasonable control.
Your mobile network provider may charge you for data usage, roaming, or other connectivity services. You are responsible for any applicable charges.
You are also responsible for maintaining a compatible device and sufficient battery power to use the Application.
12. Availability, Updates, and Changes
The Service Provider may update, modify, improve, suspend, or discontinue features of the Application from time to time.
Updates may be required for continued functionality, security, compatibility, or compliance.
The Service Provider does not guarantee that every feature will always be available or compatible with every device or operating system.
Where required by applicable law, users will be notified of material changes or given any required rights before such changes take effect.
13. Suspension and Termination
The Service Provider may restrict or suspend access to the Application where reasonably necessary to address violations of these Terms, security risks, fraud, unlawful activity, or other misuse.
Where appropriate and legally required, the Service Provider will provide notice and a reasonable opportunity to address a violation.
Immediate suspension or termination may be necessary where required by law or to address serious security threats, harmful conduct, or other urgent circumstances.
You may stop using the Application at any time by uninstalling it.
Termination does not automatically delete information previously transmitted to the Service Provider or third-party providers. Information deletion is handled in accordance with the Privacy Policy and applicable law.
14. Limitation of Liability
To the fullest extent permitted by applicable law, the Service Provider shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, the Application.
The Service Provider does not guarantee the accuracy, completeness, reliability, or suitability of AI-generated results or third-party information.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable law prohibits such exclusion.
Your statutory consumer rights remain unaffected.
15. Indemnification
To the extent permitted by applicable law, you are responsible for losses or claims arising directly from your unlawful use of the Application or your material violation of these Terms.
Nothing in this section makes you responsible for losses caused by the Service Provider's own unlawful conduct or negligence.
16. Governing Law and Disputes
These Terms are governed by the laws applicable in the jurisdiction where the Service Provider is established, subject to any mandatory consumer protection laws that apply to you.
Any dispute will be handled by a court or other competent authority with jurisdiction under applicable law. Nothing in these Terms limits any mandatory legal rights available to consumers.
17. Privacy
Your use of the Application is also governed by the applicable Privacy Policy, which explains how information may be collected, used, processed, shared, and retained.
Please review the Privacy Policy before using features that process skin photos or other personal information.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by applicable law.
19. Changes to These Terms
The Service Provider may update these Terms from time to time. The latest version will be published with an updated effective date.
Users are encouraged to review these Terms periodically. Where required by law, the Service Provider will provide notice of material changes or obtain consent before they take effect.
